New York-licensed construction law attorney needed for contract breach case against a contractor who failed to perform work despite receiving a deposit of $58,800. Timberkraft Log Homes was hired from NC to construct a single-family residence in Deposit, NY(in the amount of $283,095). We obtained all necessary approvals/permits and the construction was to begin by September 2022, but was delayed to start in fall of 2024 instead. To date they have failed to initiate any on-site construction work. Instead, the contractor sent a "new pricing" for the project, increasing the cost to $469,938.75. I was also informed that the contractor does not possess a valid license or registration certificate to build in NY. I have exhausted pre-litigation outreach and I am prepared to pursue formal action (litigation or arbitration)if a settlement is not feasible. All relevant documents, including contracts, receipts, previous demand letters, permits, site photos, and text messages, have been compiled and are ready for review. To expedite the process, I've already prepared complete initial drafts of both a complaint and a settlement offer. The new counsel can review/refine and generate their own original documents to prepare a final legal notice for phase 1 prior to litigation.
