1. Acceptance of Terms

By creating a Fairplace account, you fully agree to these Terms and Conditions and to our Privacy Policy. These Terms apply to all users; sections 4 and 5 set out additional conditions that only apply depending on the account type chosen at signup (Candidate or Company/Recruiter). If you do not agree, you must not create an account or use the service.

2. What Fairplace is

Fairplace is a job search platform that aggregates listings published by us and by third-party sources (including, without limitation, Adzuna, Jooble, Arbeitnow, and Gupy). We are not the employer for any third-party aggregated listing, we do not participate in the hiring process for those listings, and we do not guarantee the accuracy, currency, legality, or continued availability of any listed job. Applying to external listings happens on the third party's own site, under their own terms.

3. Eligibility and account

You must be at least 16 years old to create an account. You are responsible for keeping your password confidential and for all activity on your account. You agree to provide truthful, current, and complete information on signup and in your profile.

4. Specific conditions — Candidates

This section applies if you created your account as a candidate.

By submitting your résumé, profile data, or any other content ("User Content"), you grant Fairplace a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to store, reproduce, process, display, and use that User Content to: (a) operate, maintain, and improve the service; (b) process your User Content with artificial intelligence tools (including automated résumé data extraction, profile suggestion generation, and similar features); (c) display your public portfolio, if you choose to enable it; (d) share your User Content with companies you apply to; and (e) send job alerts and service-related communications.

You represent that you hold all rights necessary to the User Content you submit and that it does not infringe on any third party's rights. You are solely responsible for the accuracy of your résumé and profile information.

5. Specific conditions — Companies and Recruiters

This section applies if you created your account as a company/recruiter.

By posting or providing any job listing, description, brand, logo, or other content related to hiring processes ("Job Content"), you represent that you have the authority to do so on behalf of the company you represent, and you grant Fairplace a worldwide, non-exclusive, royalty-free license to display, distribute, index, and, where applicable, aggregate that Job Content on the service and associated distribution channels. You are solely responsible for ensuring the Job Content is accurate, current, and complies with applicable labor law, including anti-discrimination rules (age, gender, race, disability, sexual orientation, religion, and other legally protected categories). Fairplace does not take part in hiring decisions and does not guarantee the volume, quality, or fit of applications received. Specific company-account features (job posting, candidate dashboard, and related tools) may be rolled out gradually and subject to a prior sales conversation with our team.

6. Intellectual property

Fairplace, its brand, layout, design, code, and all content produced by us are our exclusive property or licensed to us, and are protected by intellectual property law. Nothing in these Terms grants you any right over those properties, other than the limited right to use the service as set out here.

7. Disclaimer of warranties

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the service will be uninterrupted, error-free, secure, or that it will result in employment or qualified applications.

8. Limitation of liability

To the maximum extent permitted by law, Fairplace, its operators, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of job or hiring opportunity, data loss, lost profits, or emotional distress, arising from use of or inability to use the service, even if advised of the possibility of such damages. Our total aggregate liability, under any circumstance, is limited to the greater of R$100.00 (one hundred reais) and the amount you paid Fairplace, if any, in the preceding 12 months.

9. Indemnification

You agree to indemnify and hold harmless Fairplace, its operators, employees, and partners from any claim, damage, loss, or expense (including reasonable legal fees) arising from your use of the service, your breach of these Terms, the User Content or Job Content you submit, or your infringement of any third party's rights.

10. Prohibited conduct

You may not: post false information; use the service for unlawful, discriminatory, or fraudulent purposes; attempt to access other users' data without authorization; reverse-engineer, run unauthorized automated scraping, or overload the service; or impersonate any person or entity, including a company you do not represent.

11. Termination

We may suspend or terminate your account at any time, with or without notice, for breach of these Terms or for any other reason at our reasonable discretion. You may close your account at any time by contacting us.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or an on-platform notice, and continued use of the service after the change constitutes acceptance of the new Terms.

13. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes will be resolved in the courts of the consumer user's domicile, in accordance with the Brazilian Consumer Protection Code.

1. Who we are and what this document covers

This Privacy Policy explains what personal data Fairplace collects, what we use it for, who we share it with, and what rights you have over it. It complements our Terms and Conditions and applies to candidates, companies/recruiters, and site visitors.

2. Data we collect

Account data: name, email, and password (encrypted) when you sign up.

Profile data (optional): location, skills, work experience, education, résumé PDF, and the text extracted from it — anything you choose to fill in.

Application data: when you apply to a job, we collect name, email, phone, city, résumé, and an optional message, even without a created account.

IP-based location: we use the ipinfo.io service to estimate city/country from your IP address, exclusively to suggest "jobs near you" on the homepage and, on your first visit to the site, to pre-select the display language. This lookup is not saved tied to your account — it's done on the fly on each visit, and only the chosen language (not the location) is saved in your browser.

Technical data: essential session (login) and language-preference cookies. We do not use third-party tracking cookies or advertising pixels.

3. What we use your data for

(a) Operating your account and authentication; (b) enabling job applications and sending them to the corresponding companies; (c) generating email job alerts based on your preferences; (d) displaying your public portfolio, if you enable that option; (e) processing your résumé with artificial intelligence tools to extract information and suggest profile autofill; (f) suggesting relevant jobs based on your approximate location; (g) complying with legal obligations and preventing fraud.

4. Who we share it with

We share your application data (including résumé) only with the company you applied to, by email. We do not sell personal data to third parties or share it with advertisers. We use infrastructure providers (hosting, email delivery, IP geolocation, AI processing) strictly to operate the service, under confidentiality obligations.

5. Retention

We keep your account data while it remains active. Standalone application data (no account) is retained for as long as needed for the company to evaluate the application, plus a reasonable period afterward for support and fraud-prevention purposes. You can request deletion at any time (section 7).

6. Legal basis and international compliance

We process your data based on your consent (by accepting these documents), on the performance of the service you requested (application, alert, portfolio), and on our legitimate interest in operating and improving the platform. For users in Brazil, we follow the General Data Protection Law (LGPD, Law 13.709/2018). For users in the European Union/European Economic Area, we follow the General Data Protection Regulation (GDPR), and we commit to tracking future EU regulatory updates applicable to this service as they take effect.

7. Your rights

You can, at any time: (a) access the data we hold about you; (b) correct inaccurate data directly in your profile; (c) request deletion of your account and associated data; (d) request a portable copy of your data; (e) withdraw your consent, which may limit features that depend on it. To exercise these rights, use the contact channels available on the site.

8. Security

Passwords are stored hashed (never in plain text). We use encrypted connections (HTTPS) across the entire site. No system is 100% risk-free, and we commit to notifying you in the event of a security incident affecting your data, as required by law.

9. Minors

The service is intended for users 16 years or older, per our Terms. We do not knowingly collect data from users under 16.

10. Changes to this policy

We may update this Policy from time to time. Material changes will be communicated by email or an on-platform notice.
