I am seeking an initial consultation with a specialized immigration attorney who possesses dual expertise in U.S. immigration law and international Assisted Reproductive Technology (ART) / surrogacy cases. My wife and I are currently navigating an international surrogacy journey and require sophisticated legal counsel to structure our document portfolio and ensure the seamless, lawful entry of our child into the United States. The Fact Pattern ⚬ Intended Parents (IPs): Both my wife and I are U.S. Lawful Permanent Residents (LPRs). ⚬ Birth Country: Nigeria (via a gestational surrogate). ⚬ Genetics & Conception: The child was conceived via ART using my genetic material (sperm) and a donor egg. ⚬ The Complication: My wife has no genetic or gestational link to the child. The Core Legal Challenge Our primary objective is to bring our child to the U.S. under the visa waiver rule for children born abroad to LPR mothers (8 CFR § 211.1(b)(1) / INA § 211(a)). Given that current U.S. Customs and Border Protection (CBP) and Department of State (DOS) guidelines strictly evaluate genetic and gestational relationships when establishing maternity for immigration purposes, we need strategic counsel on the following: How can we structure our legal document portfolio (e.g., Nigerian court orders, birth certificates, and declarations) to ensure CBP and USCIS legally recognize my wife as the "mother" for the purpose of the 8 CFR § 211.1 visa waiver upon our return to the U.S.? Pre-Birth Strategy: Advising on the necessary legal steps in Nigeria (in coordination with our local Nigerian counsel) to establish undeniable parental rights for my wife prior to or immediately at birth. 2. Document Structuring: Creating a foolproof portfolio of legal documentation (birth certificate, passports, custody orders) that satisfies CBP’s scrutiny at the Port of Entry. 3. Contingency Planning: Outlining alternative visa application processes (e.g., filing an I-130 or utilizing humanitarian parole) should the visa waiver route be deemed legally unviable due to the lack of a biological/gestational link. 4. Border Preparation: Providing a legal brief or letter of counsel to accompany us at the Port of Entry to advocate for the child's admission.
